Attorney James B. Winston focuses his practice in the following areas of law: Family Law, Employment Law, and Social Security Appeals (SSDI & SSI cases).
FAMILY LAW
Attorney Winston’s experience in Family Law began when he served as a law clerk for the Massachusetts Probate and Family Court. During the clerkship, Jim worked in all four of the Probate and Family Courts in western Massachusetts, working directly for all of the judges that hear family law related cases in Northampton, Springfield, Pittsfield, and Greenfield.
Jim’s practice includes handling a variety of cases involving divorces, child custody issues including paternities and child support, as well as post-divorce cases, including complaints for modification and contempts. There is never a charge for the initial consultation.
Jim also serves as a Guardian Ad Litem and Guardian in the Massachusetts Probate & Family Court.
EMPLOYMENT LAW
Including Unemployment Hearings
Attorney Winston practices in the area of Employment Law, and has handled cases at the Massachusetts Commission Against Discrimination, as well as Superior Court, involving claims of sexual harassment, pregnancy, Family Medical Leave Act (FMLA) issues, gender discrimination and sexual orientation, as well as claims centering on race discrimination, age discrimination, disability discrimination, and wrongful discharge and retaliation claims. Attorney Winston is also a member of the Massachusetts Employment Lawyers Association.
The James B Winston Law Office provides counseling services, which include:
- Drafting and reviewing employment contracts as well as severance packages.
- Developing and drafting employee handbooks and codes of business conduct.
- Reviewing and drafting non-compete agreements.
Attorney Winston has lectured on the topic of employment law to business owners and also teaches a course at Western New England College focusing on employment law, including discrimination claims in the workplace. Jim also has considerable experience in representing litigants at unemployment hearings throughout western Massachusetts.
SOCIAL SECURITY APPEALS (SSDI & SSI Cases)
Attorney Winston has helped many claimants receive the benefits that they deserve from the Social Security Administration. Whether it is an appeal of a denial of Social Security Disability Insurance (SSDI) benefits, or Supplemental Security Income (SSI) benefits, Attorney Winston has brought cases before all the Administrative Law Judges that regularly hear cases in Western Massachusetts. All appeals taken by the James B. Winston Law Office will be based on a statutory contingency fee agreement.
